LEGAL NOTICE MORTGAGEE'S SALE OF REAL ESTATE By virtue of and in execution of the Power of Sale contained in a certain mortgage given by Matthew Procek to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for WMC Mortgage Corp., its successors and assigns, dated September 15, 2005 and recorded in Barnstable County Registry of Deeds in Book 20262, Page 208 (the “Mortgage”) of which mortgage Deutsche Bank National Trust Company, as Trustee for GSAMP Trust 2005-WMC3 is the present holder by Assignment from Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for WMC Mortgage Corp., its successors and assigns to Deutsche Bank National Trust Company, as Trustee for GSAMP Trust 2005-WMC3 dated March 14, 2022 and recorded at said Registry of Deeds in Book 34976, Page 207, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 112 Edgewater Drive East, Falmouth (East Falmouth), MA 02536 will be sold at a Public Auction at 12:00 PM on June 5, 2024, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit: The land with the buildings thereon in East Falmouth, Barnstable County, Massachusetts, bounded and described as follows: WESTERLY by Edgewater Drive East, as shown on a plan hereinafter mentioned, Eighty (80) feet; NORTHERLY by Lot 9, Section D, as shown on said plan, One Hundred Seventy-Five (175) feet, more or less; EASTERLY by Childs River, as shown on said plan, Sixty (60) feet, more or less; and SOUTHERLY by Lot 11, Section D, as shown on said plan, One Hundred Seventy (170) feet, more or less. Said premises are shown as LOT 10, Section D, on a plan entitled "Seacoast Shores," Section A,B,C,D, dated April 15, 1947, be Fredrick C. Hahn, Surveyor, recorded with Barnstable County Registry of Deeds, Plan Book 78, Page 13. Being the same premises conveyed to the herein named grantor(s) by deed recorded herewith. For mortgagor’s title see deed recorded with the Barnstable County Registry of Deeds in Book 20262, Page 207. The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession.
